Do you need to submit an RFE? Are you applying for I-765 Extensions?

In its effort to minimize the consequences for those seeking immigration benefits during the Coronavirus pandemic, USCIS is taking several flexible steps to help mitigate the stress inherent in filing deadlines and other immigration issues as set forth below.

If you are responding to requests for evidence (RFEs) and notices of intent to deny (NOIDs) dated between March 1 and May 1, 2020, any responses submitted within 60 calendar days after the response deadline set forth in the RFE or NOID will be considered by USCIS before any action is taken. This flexibility also applies to certain Notices of Intent to Revoke (NOIR) and Notices of Intent to Terminate (NOIT) regional investment centers as well as certain filing date requirements for form I-290B, Notice of Appeal or Motion.

To summarize, this flexibility applies to an RFE, NOID, NOIR, NOIT or appealable decision within AAO jurisdiction and the issuance date listed on the request, notice or decision is between March 1, 2020 and May 1, 2020, inclusive.

USCIS also announced that even though Application Support Centers (ASC) are closed, USCIS will reuse previously submitted biometrics in order to process valid Form I-765, Application for Employment Authorizations extensions. This policy was already in place but is being reiterated here for reassurance while the Application Support Centers remain closed.
